Terms of Service

WRDB SCP ("WRDB," "we," "our," or "us") operates the WRDB mobile application (the "App"). These Terms of Service ("Terms") govern your access to and use of the App. Please read them carefully before creating an account or using the App.

1. Acceptance of Terms

By creating an account, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

You must be at least 13 years of age to use the App. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App. We do not knowingly collect personal information from children under 13, consistent with our Privacy Policy.

2. Description of Service

WRDB is an iOS wardrobe management application that provides the following features:

• Wardrobe Cataloguing: Upload photographs of clothing items to build a digital wardrobe. Items are stored securely and organised by type, colour, material, and other attributes.
• AI-Powered Analysis: Garment photos are automatically analysed using artificial intelligence to identify clothing attributes such as type, colour, pattern, material, brand, size, and condition. Background removal is applied for cleaner display.
• Outfit Recommendations: The App generates personalised outfit suggestions based on your wardrobe, style preferences, weather conditions, and occasions using on-device machine learning and vector-based similarity matching.
• Social Features (OOTD): Share your Outfit of the Day posts with the community, follow other users, like posts, and interact with a social feed.
• Product Recommendations: Discover fashion products through affiliate recommendations matched to your style and wardrobe needs.
• Weather Integration: Receive weather-aware outfit suggestions based on your approximate location.

The App is provided free of charge. We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice.

3. Account Registration

To use the App, you must create an account using Apple Sign In or email registration. When you create an account, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the accuracy of your information and update it as needed.
• Keep your login credentials secure and not share them with others.
• Be responsible for all activity that occurs under your account.
• Notify us immediately at wardrobe@wrdb.site if you suspect unauthorised use of your account.

You may only create one account per person. We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used for fraudulent purposes.

4. User Content and Intellectual Property

Your Content

You retain ownership of all photographs and content you upload to the App ("User Content"). By uploading User Content, you grant WRDB a limited, non-exclusive, royalty-free, worldwide licence to:

• Store, process, and display your User Content within the App for the purpose of providing the service.
• Analyse your photographs using AI and machine learning to extract garment attributes and generate recommendations.
• Display your User Content to other users according to your chosen visibility settings (public or private).

This licence exists solely to enable the functionality of the App and terminates when you delete your content or your account.

Our Content

The App, including its design, algorithms, machine learning models, text, graphics, logos, and software, is owned by WRDB SCP and protected by intellectual property laws. You may not:

• Copy, modify, distribute, or create derivative works of the App or its content.
• Reverse-engineer, decompile, or disassemble the App or its underlying technology.
• Remove or alter any copyright, trademark, or other proprietary notices.
• Use our trademarks, logos, or brand elements without prior written permission.

5. Acceptable Use

You agree to use the App in a lawful and respectful manner. You must not:

• Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Upload content that infringes the intellectual property rights, privacy, or other rights of any third party.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Harass, bully, intimidate, or threaten other users.
• Spam, solicit, or send unsolicited communications to other users.
• Attempt to gain unauthorised access to the App, other users' accounts, or our servers and systems.
• Use automated tools, bots, or scripts to access, scrape, or interact with the App.
• Use the App for any commercial purpose without our prior written consent.
• Circumvent, disable, or interfere with any security features of the App, including rate limiting and abuse prevention measures.
• Interfere with or disrupt the App or the servers and networks connected to it.

We reserve the right to investigate and take appropriate action against any user who violates these Terms, including removing content, suspending access, or terminating accounts.

6. AI and Automated Features

The App uses artificial intelligence and machine learning technologies to enhance your experience:

• Cloud AI Analysis: When you upload a garment photo, it may be processed by OpenAI's Vision API to classify clothing attributes and by PhotoRoom's API to remove the image background. These services process your photos securely and do not retain them beyond what is necessary for processing.
• On-Device ML: Outfit generation and garment similarity matching use on-device CoreML models (CLIP embeddings). This processing occurs locally on your device and your data is not transmitted to external servers for this purpose.
• Weather Data: Approximate location is used to retrieve weather information from Apple WeatherKit for weather-aware outfit suggestions. Your location is not stored.

AI outputs, including garment classifications, outfit recommendations, and product suggestions, are generated algorithmically and provided as suggestions only. They do not constitute professional styling, fashion, or purchasing advice. Results may be inaccurate, incomplete, or unsuitable for your needs. You are always responsible for your own decisions regarding what to wear, purchase, or share.

7. Social Features

The App includes social features that allow you to:

• Follow other users and build a network.
• Share Outfit of the Day (OOTD) posts with the community.
• Like and interact with other users' posts.
• View an activity feed of social interactions.

Visibility and Privacy

You can control your account visibility by setting your profile to public or private. Public content is visible to all App users. Private accounts restrict visibility to approved followers only.

Moderation

You can report inappropriate content or users, block users you do not wish to interact with, and mute users whose content you do not wish to see. We may review reported content and take action at our discretion, including removing content or suspending accounts that violate these Terms. However, we do not guarantee that we will monitor all user-generated content.

Your Responsibility

You are solely responsible for the content you post and share through the App's social features. You should not share content that you do not have the right to share or that violates the rights of others.

8. Advertising and Affiliate Links

The App displays advertisements provided by Google AdMob. Advertisements may be personalised based on your profile information and usage patterns, subject to your consent and Apple's App Tracking Transparency framework.

The App may also include product recommendations through the Awin affiliate network. When you interact with or purchase products through these recommendations, WRDB may earn a commission from the merchant. Affiliate product recommendations are generated based on your wardrobe analysis and style matching.

Third-party products and services accessed through advertisements or affiliate links are governed by their own terms of service and privacy policies. WRDB is not responsible for the quality, safety, or suitability of third-party products or services, nor for any transactions between you and third-party merchants.

9. Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the App, you acknowledge that you have read and understood our Privacy Policy. Key points include:

• Your primary data is stored on servers located in the European Union.
• You have granular control over data processing through consent toggles in the App's settings.
• You can export all your personal data at any time.
• You can delete your account and all associated data at any time.
• Certain features involve data transfer to processors in the United States, protected by Standard Contractual Clauses.

10. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be available at all times or without interruption.
• The App will be free from errors, bugs, or security vulnerabilities.
• AI-generated classifications, recommendations, or suggestions will be accurate, complete, or suitable for your needs.
• User Content posted by other users will be accurate, lawful, or appropriate.

AI recommendations are not a substitute for professional styling, fashion, or purchasing advice. You acknowledge that you use the App and rely on its features at your own discretion and risk.

Nothing in this section excludes or limits warranties that cannot be excluded or limited under applicable law, including mandatory consumer protection laws of the European Union or its Member States.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• WRDB shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
• WRDB shall not be liable for any loss of data, loss of profits, loss of goodwill, or business interruption.
• WRDB's total aggregate liability for all claims arising out of or related to these Terms or your use of the App shall not exceed the greater of (a) the amount you paid to WRDB in the 12 months preceding the claim, or (b) EUR 50.

This limitation of liability does not apply to:

• Liability arising from fraud, gross negligence, or wilful misconduct by WRDB.
• Liability for death or personal injury caused by WRDB's negligence.
• Any liability that cannot be excluded or limited under applicable law, including mandatory consumer protection rights under EU law or the law of your country of residence.

12. Account Termination

By You

You may delete your account at any time through the App's Settings. When you delete your account, all your personal data will be removed in accordance with our Privacy Policy, including complete deletion across all database tables, storage, and authentication records within 30 days.

By Us

We may suspend or terminate your account if:

• You violate these Terms or our acceptable use policies.
• Your account is used for fraudulent or illegal activities.
• We are required to do so by law or regulation.
• We discontinue the App or any material part of it.

If we terminate your account for cause, we will make reasonable efforts to notify you. You may contact us at wardrobe@wrdb.site to request an explanation or appeal any termination decision.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or by email to the address associated with your account. The updated Terms will indicate the new "Last Updated" date at the top.

Your continued use of the App after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you should stop using the App and delete your account.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain, except as provided below.

EU Consumer Rights

If you are a consumer residing in the European Union, nothing in these Terms affects your mandatory rights under the consumer protection laws of your country of residence. In accordance with EU Regulation 1215/2012, you retain the right to bring proceedings in the courts of the Member State in which you are domiciled.

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution proceedings, but we are committed to resolving disputes in good faith.
